Johnson’s Pond Civic Association Yamaha VX Cruiser Wave Runner Raffle 2016

Official Rules and Regulations

The proceeds from this raffle will benefit the Johnson’s Pond Civic Association and our continued efforts to improve and protect our pond environment and local community. Raffle entry will be $75.00 per ticket, unlimited individual and/or total purchases.

Raffle Rules

  1. The raffle is open to all legal residents of the United States who are age 18 and over.
  2. The winning ticket will be drawn at random.
  3. The total number of tickets that will be sold for this drawing is 200.
  4. There is no limit to the number of tickets an individual may purchase, up to the maximum number of tickets available.
  5. If fewer than 200 tickets are sold by 11:00 AM, June 15, 2016, JPCA may cancel the raffle at its sole discretion, and any participant who has previously purchased a raffle ticket will be refunded the cost of each ticket purchased within 10 business days.
  6. No additional purchase (donation, admission, membership, etc.) is necessary to purchase raffle tickets or win the prize.
  7. Tickets must be filled out in the name of a single individual.
  8. Tickets are non-refundable except as described in item No. 5 above.
  9. Ticket sales will cease at 11:00 AM on Sunday, August 7th, 2016 or until supplies run out.
  10. The winner will be selected at a random drawing on Sunday, August 7th, 2016 between 1:30 - 3:30 PM.
  11. Entrants do not need to be present to win. The winner will be notified by phone according to the contact information provided to JPCA on the raffle ticket stub. In the event a winner cannot be contacted, fails to respond within 7 calendar days, fails to otherwise qualify for the prize and / or declines the prize, an alternate winner will be selected. If not claimed within 7 calendar days of being notified, the winner designee will forfeit any rights to the prize and the same will be awarded to an alternate winner. The right to take possession of the prize through the winning entry is neither assignable nor transferable.
  12. The winning ticket number will be posted on our website www.johnsonspond.com following the drawing.
  13. The winner must present his or her numbered ticket stub and must have proper picture ID (a valid state driver’s license) to claim the prize.
  14. It is the ticket buyers’ responsibility to register their ticket by fully completing and returning the proper stub portion of the entry ticket. All entry ticket stubs along with the $75.00 per ticket purchase price must be returned by 11:00 AM on Sunday, August 7th, 2016 to guaranty a place in the drawing.
  15. If the winner elects to take the prize, that winner assumes and must pay all fees and charges (including, but not limited to, state registration fees) local, state and federal taxes when the prize is transferred to the winner. Winnings are subject to regular withholding as stipulated by the IRS and must be paid by the winner. In addition, all costs of prize ownership, such as (without limitation) insurance, are the winner’s sole responsibility. JPCA assumes no responsibility for the winner’s tax obligations and suggests you consult your tax advisor. This offer is void where prohibited by law and all federal, state and local laws and regulations apply. The prize cannot be exchanged for cash. If the winner elects not to accept the prize, no substitution or exchange for cash or other goods will be provided.
  16. Any expense incurred with the pickup of the prize will be the responsibility of the winner.
  17. Winner is responsible for all costs associated with obtaining any required boating education and certification required by state and federal laws.
  18. By receipt of the prize, winner agrees to release and hold harmless JPCA, its advertising/promotion agencies, and prize suppliers, and each such company’s officers, directors, employees, volunteers and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the raffle or receipt or use or misuse of the prize.
  19. Except where prohibited, participation in the raffle constitutes winner’s consent to JPCA, their sponsor’s and its agents’ use of winner’s name, photograph, and/or hometown and state for promotional purposes in any media, without further payment or consideration.
  20. JPCA reserves the right to cancel, suspend and/or modify the raffle, or any part of it, if any fraud, technical failures or any other factor beyond JPCA’s reasonable control which impairs the integrity or proper functioning of the raffle, as determined by JPCA in its sole discretion. JPCA reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the raffle process or to be acting in violation of these official Rules or other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the raffle may be a violation of criminal and civil law, and, should such an attempt be made, the JPCA reserves the right to seek damages from any such person to the fullest extent permitted by law. The JPCA’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  21. For the prize winner and/or a copy of these Official Rules and Regulations, send a request to treasurer@johnsonspond.com. All requests must be received by August 30th, 2016.
